AI Usage Policy

MA Digitals Solution Inc. Last Updated: October 16, 2026

1. Purpose and Scope

MA Digitals Solution Inc. ("Company", "we", "us", or "our") uses artificial intelligence ("AI") tools to help deliver faster, higher-quality digital services. This AI Usage Policy explains when and how we use AI, the safeguards we apply, and the choices available to you on www.madigitals.ca (the "Website") and in our services (the "Services").

This Policy applies to our employees, contractors, and service providers, and covers AI features on the Website as well as AI tools used in client projects. It should be read together with our Privacy Policy, Cookie Policy, and Terms and Conditions.

We aim to use AI in line with applicable law in Canada and the United States, including, where applicable:

  • Canada: the Personal Information Protection and Electronic Documents Act (PIPEDA); provincial privacy laws, including Quebec's Law 25 (which includes transparency rules for automated decisions); the Canadian Human Rights Act and provincial human rights codes; the Competition Act (misleading advertising); the Copyright Act; and Canada's Anti-Spam Legislation (CASL).
  • United States: the Federal Trade Commission Act (prohibiting unfair or deceptive practices, including misleading claims about AI); state consumer privacy laws such as the CCPA/CPRA; state AI and automated decision-making laws, such as the Colorado AI Act and Utah's AI disclosure law, where applicable; anti-discrimination laws; the Children's Online Privacy Protection Act (COPPA); and U.S. copyright law.

We also look to recognized frameworks such as the NIST AI Risk Management Framework and Canada's Voluntary Code of Conduct on generative AI. AI regulation is changing quickly, and we will update this Policy as the law develops.

3. Our Principles

  • Human oversight: AI assists our people; it does not replace professional judgment. A qualified person reviews AI-assisted work before it is delivered.
  • Transparency: we tell you when you are interacting with AI and when AI materially contributed to a deliverable, where required by law or contract.
  • Privacy and security: we protect personal and confidential information when using AI tools.
  • Fairness: we work to avoid unlawful bias and discrimination in how we use AI.
  • Accuracy and accountability: we verify AI outputs and take responsibility for the work we deliver.
  • Lawful and ethical use: we do not use AI to deceive, harm, or break the law.

4. How We Use AI

Depending on the engagement, we may use AI tools to:

  • Brainstorm, draft, edit, and translate copy, blog posts, and marketing materials.
  • Generate or refine design concepts, images, and layouts.
  • Write, review, test, and debug code.
  • Analyze data, summarize research, and identify SEO and content opportunities.
  • Power website features such as chatbots, search, or recommendations.
  • Improve internal productivity, such as meeting notes and project management.

5. Uses We Do Not Permit

We do not use AI, and our personnel are not permitted to use AI, to:

  • Make solely automated decisions that have legal or similarly significant effects on individuals (for example, employment, credit, housing, insurance, or access to essential services) without appropriate human review.
  • Create deepfakes or synthetic media that impersonate real people without consent, or that are intended to mislead.
  • Generate fake reviews, testimonials, or endorsements, or other deceptive marketing content.
  • Produce discriminatory, harassing, defamatory, or unlawful content.
  • Develop malware, run unauthorized surveillance, or violate others' security or privacy.
  • Infringe intellectual property or confidentiality rights.
  • Build or deploy biometric identification or emotion recognition tools on individuals without a lawful basis and appropriate consent.

6. Personal Information and Confidential Data

  • We do not enter client confidential information, trade secrets, credentials, or personal information into public AI tools that use inputs to train their models.
  • We prefer enterprise or business-tier AI services with contractual commitments on data protection, security, and no training on our inputs, and we review the terms of the AI vendors we use.
  • We minimize, de-identify, or anonymize personal information before using it in AI tools whenever practical.
  • Where AI processing involves personal information, we do so in accordance with our Privacy Policy, obtain consent where required, and use it only for stated purposes.
  • AI vendors that process data for us are treated as service providers and are bound by contracts requiring appropriate safeguards. Data may be processed in Canada, the United States, or other countries.

If you do not want AI tools used on your confidential materials, tell us before the project begins, and we will work with you to agree on alternatives.

7. Transparency and Disclosure

  • AI interactions: if the Website uses a chatbot or other AI system to interact with you, we will clearly identify it as AI, and you may ask to speak with a person.
  • AI-assisted work: unless otherwise agreed, AI may be used as a tool in preparing Deliverables. Where the law, a platform, or your contract requires disclosure of AI-generated content, we will disclose it.
  • Automated decisions: if we ever use automated processing to make a decision about you, we will tell you, explain the main factors on request, and offer human review, as required by laws such as Quebec's Law 25 and applicable U.S. state laws.

8. Human Review, Accuracy, and Limitations

AI systems can produce inaccurate, incomplete, outdated, biased, or misleading output, sometimes presented with confidence. We review and fact-check AI-assisted content before delivery. Even so, we ask that you review Deliverables for accuracy and suitability, especially for legal, medical, financial, or other regulated content, which AI should not replace professional advice.

9. Bias and Fairness

We take reasonable steps to identify and reduce bias in AI-assisted work, including selecting reputable tools, reviewing outputs for discriminatory content, and applying human judgment. If you believe an AI-assisted output is biased or unfair, please let us know so we can address it.

  • Ownership: ownership of Deliverables is governed by our Terms and Conditions and your project agreement.
  • AI-generated content and copyright: in both Canada and the United States, copyright protection for works created without meaningful human authorship is uncertain, and the U.S. Copyright Office generally requires human authorship. Purely AI-generated material may therefore have limited or no copyright protection. We apply human creativity and editing to Deliverables where possible, but cannot guarantee that AI-assisted works are protectable.
  • Third-party rights: we use reasonable efforts to avoid infringement, but AI output may resemble existing works. We use AI tools whose terms permit commercial use of outputs.
  • Your materials: we use materials you provide solely to deliver the Services, and not to train AI models, unless you give written permission.

11. Security

We apply access controls, vendor reviews, and staff guidance to protect information handled with AI tools. Personnel are trained to use approved tools only and to report suspected misuse or data exposure. If an incident involving AI creates a real risk of significant harm to individuals or otherwise triggers legal obligations, we will notify affected parties and regulators as required by law.

12. Marketing and Advertising Claims

We do not make false or unsubstantiated claims about our AI capabilities or results, and we do not use AI to create deceptive advertising. Digital marketing outcomes, including those supported by AI tools, are not guaranteed.

13. Children

Our AI features are not directed to children under 13 (or the higher age set by applicable law), and we do not knowingly collect their personal information through AI tools.

14. Your Choices and Rights

You may contact us to:

  • Ask whether and how AI was used in your project.
  • Request that we limit or avoid AI tools for your confidential materials.
  • Request human review or an explanation of any automated decision affecting you.
  • Exercise your privacy rights (access, correction, deletion, opt-out, withdrawal of consent) described in our Privacy Policy.
  • Report a concern or complaint about our use of AI.

You may also contact the Office of the Privacy Commissioner of Canada, your provincial regulator, the U.S. Federal Trade Commission, or your state attorney general.

15. Governance and Training

Our management is responsible for this Policy. We maintain a list of approved AI tools, assess new tools for privacy, security, and legal risk before use, train personnel on responsible AI use, and review this Policy at least annually.

16. Limitation of Responsibility

Subject to applicable law and our Terms and Conditions, we are not liable for decisions you make based on AI-assisted content without appropriate review, or for the actions of third-party AI providers outside our reasonable control. Nothing in this Policy limits rights you have under law that cannot be waived.

17. Changes to This Policy

We may update this Policy to reflect changes in technology, law, or our practices. The updated version will be posted on this page with a revised "Last Updated" date, and where required by law we will provide additional notice.
